Like any adoption plan, each open adoption agreement is unique. They are based on the needs and wishes of each family concerned. For example, in some open adoption contracts, letters and images must be sent to the birthing parent once a year or more frequently. Other open adoption agreements include more intimate interactions, whether through phone calls, emails, text messages, video conversations or personal conversations. In many legal systems, the law requires the court to prove, in the context of the adoption application, that all parties involved have been informed of the availability of the ACAP and their right to participate. In Pennsylvania, these agreements are created by law. Another reason why open adoption agreements are largely unworkable legally is the simple fact that no one knows what the future holds. Most adoptive families participate in adoption with the intention of keeping the promises of contact they made to birth families prior to adoption. But life happens and sometimes it doesn`t work. Sometimes either the birth family or the adoptive family can move to a territory that makes personal contact impossible or extremely difficult. It`s not that they don`t want their child to be in contact with their family in person – it`s not feasible.
In the best interests of the child, «open adoption is a form of adoption that allows birth parents to know and connect with the adoptive parents and the adopted child. Adoption agencies or professionals you are talking to may describe open adoptions differently. Many adoption agencies now offer open adoption agreements because they have advantages. Open adoption agreements can alleviate many of the fears that will arise during the adoption process, such as: what if the adoptive parents wanted to meet in person, but I am not prepared to do so? Or if I want to have more (or less) contact with my child`s birth family? What happens if the other party changes their phone number or address? So what`s going on? Open adoption contracts can also ensure that everyone stays happy and that promises are kept.
